HEALTHY BEVERAGE, LLC'S WEBSITE PRIVACY POLICY

We respect and are committed to protecting your privacy. That is why we have adopted this Privacy Policy. This Privacy Policy lets you know how and for what purposes your personal information is being collected, processed and used. We pledge that we will take reasonable steps to ensure that your personal information will only be used in ways that are in compliance with this Privacy Policy. This Privacy Policy is only in effect for any web pages, mobile applications, third party social media sites, email lists, onsite electronic data collection, collective non user-specific information, and collective personal information collected and/or owned by Healthy Beverage, LLC (collectively, "Healthy Beverage," "Steaz," "our," "us" or "we"), including, but not limited to, the Healthy Beverage website located at www.steaz.com, as well as any online features, services and/or programs offered by Healthy Beverage (collectively, the "Website"). We will make an effort to update this web page with any changes to this Privacy Policy and you are encouraged to review this Privacy Policy frequently (the date of the most recent revision to this Privacy Policy appears at the end of this Privacy Policy).

USE OF INFORMATION

Information collected by us is used for three main purposes. First, we collect information to improve the Website by determining which of our areas, features and forums are most popular. Second, we may now or in the future collect information to personalize the experience of the users of the Website. Finally, we collect information to communicate with you and to inform you about our products. Other than to send you information about our products, we do not use our users' email addresses or other personally identifiable information for commercial or marketing purposes without your consent or except as part of a program or feature for which you will have the ability to opt-in or opt-out. That being said, we may use your email address without further consent for non-marketing or administrative purposes. In order to participate in certain features, services and/or programs of the Website, we may require that you provide us with certain specific information, such as your full name, company information, mailing address, telephone number, email address, personal interests and/or other information specific to you. You can choose whether or not to provide us with this information, but if you choose not to provide any required information, your experience on the Website may be diminished and some features may not be available or may not work as intended. We or one of our partners may sponsor promotions, sweepstakes or contests on the Website. Your participation is entirely voluntary. Users may be asked to provide personal information including name, email address or home address or to answer questions in order to participate. We may also transfer personal information to certain advertising or marketing partners from whom you have requested to receive information.

Additional Ways that Information is Collected

Browser Log Files

Our servers automatically log each visitor to the Website and collect and record certain information about each visitor. This information includes or may include your "Internet Protocol" or IP address, Unique Device Identifier, browser language, browser type, operating system, domain names, browsing history (including time spent at a domain, time and date of your visit), referring/exit web pages and URLs, and number of clicks. The domain name and IP address reveal nothing personal about the user other than the IP address from which the user has accessed the Website. We may use this information to examine our traffic in the aggregate, but we do not collect and evaluate this information for individuals. Our web servers do not automatically record email addresses of users.

Cookies

From time to time, we and/or our advertisers may use "cookies" to keep track of your visit and use of the Website. A cookie is a small piece of data that your Internet browser stores on your computer's hard drive. A cookie, by itself, cannot read data from your hard disk or read cookie files created by other websites. A cookie, by itself, does not damage your system. We may use cookies to identify and keep track of, among other things, those areas of the Website and third party websites that you have visited in the past in order to enhance your next visit to the Website. Our advertisers may also use cookies to ascertain how many times that you have seen an advertisement. We and our advertisers may use this information to better personalize the content, banners and promotions that you see on the Website. You can choose whether or not to accept cookies by changing the settings of your Internet browser. If you choose not to accept cookies, your experience on the Website may be diminished and some features may not be available or may not work as intended. The Website may also contain electronic images known as Web Beacons (sometimes referred to as "clear gifs"). Web Beacons collect only limited information that includes a cookie number, time and date of a page view, and a description of the page on which the Web Beacon resides. We may also carry Web Beacons placed by third-party advertisers. These Web Beacons do not carry any personally identifiable information and are only used to track usage of the Website and activities associated with the Website.

When Information Is Disclosed By Healthy Beverage

In addition to the other times or occasions on which we might disclose information about users of the Website, we might also disclose information when required by law or in the good-faith belief that such disclosure is necessary to: (a) comply with a legal process and applicable laws; (b) enforce this Privacy Policy; (c) respond to claims that any materials, documents, images, graphics, logos, designs, audio, video and any other information provided from or on the Website violates the rights of third parties; or (d) protect the rights, property or personal safety of us, our users or the public. We use reasonable precautions to keep the information that is disclosed to us secure. We provide personally identifiable information and non-personally-identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We require that these parties agree to process such information in compliance with our Privacy Policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures. The use of your information by one of our trusted business partners may be subject to that party's own privacy statement or policy. We do not use our users' email address or other personally identifiable information for commercial or marketing purposes without your consent or except as part of a program or feature for which you will have the ability to opt-in or opt-out. We do share non-personally-identifiable information (such as anonymous user usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third parties to demonstrate the usage patterns for our advertisements, content, functionality promotions and/or services on the Website. We also reserve the right to disclose personally identifiable information and/or non-personally-identifiable information in connection with the enforcement of our Terms of Use located at www.steaz.com/terms-of-use/, to take precautions against liability, to investigate and defend against any third party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Website, and to protect the rights, property, or personal safety of us, our users or others. We reserve the right to transfer your personally identifiable information, as well as any other information, in connection with the sale or other disposition of all or part of our business and/or assets. We also cannot make any representations regarding the use or transfer of your personally identifiable information or other information that we may have in the event of our bankruptcy, reorganization, insolvency, receivership or an assignment for the benefit of creditors, and you expressly agree and consent to the use and/or transfer of your information in connection with a sale or transfer of some or all of our assets in any of the above described proceedings. Furthermore, we cannot and will not be responsible for any breach of security by any third parties or for any actions of any third parties (including other users of the Website) that receive any of the information that is disclosed to us. The Website also links to a wide variety of other websites and the Website may contain advertisements of third parties. We are not and cannot be responsible for the privacy policies of those websites of third parties or how they treat information about their users.

Information From Children

The Website is not intended or designed to attract children under the age of thirteen (13). We do not collect personally identifiable data from any person who we know to be under the age of thirteen (13). You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy. In any case, you affirm that you are over the age of 13, as THE WEBSITE IS NOT INTENDED FOR CHILDREN UNDER 13 WHO ARE UNACCOMPANIED BY HIS OR HER PARENT OR LEGAL GUARDIAN. CHILDREN UNDER 13 ARE NOT PERMITTED TO USE THE WEBSITE. If we learn that a user under the age of thirteen (13) is publicly posting or sharing personally identifiable information through the Website, then we will use commercially reasonable measures to block that user from using the Website. Parents should be aware that our Privacy Policy will govern our use of personal data, but also that information that is voluntarily given by children – or others – in email exchanges, bulletin boards or the like may be used by other parties to generate unsolicited communications. We encourage all parents to instruct their children in the safe and responsible use of their personal data while using the Internet.

Privacy Outside the Website

The Website may contain various links to other websites, including links to various third party service providers. We are not and cannot be responsible for the privacy practices or the content of any of those other websites. Other than under agreements with certain reputable organizations and companies, and except for third party service providers whose services you voluntarily elect to utilize, we do not share any of the personal information that you provide to us with any of the websites to which the Website links, although we may share aggregate, non-personally identifiable data with those other websites. Please check with those websites in order to determine their privacy policies and your rights under them.

Information Security

We make every effort to ensure that information collected through the Website is not lost, misused or altered inappropriately by administering security measures. However, all information transferred over the Internet can potentially be accessed by unauthorized parties; therefore, we cannot guarantee the security of your data transmitted to the Website.

Choices With Your Personal Information

Whether you submit personally identifiable information to us is entirely up to you. You may decide not to submit personally identifiable information through the Website, in which case we may not be able to provide certain features, services and/or programs to you. Please note that any information that you post, upload or transmit to us and/or the Website remain subject to our Terms of Use located at www.steaz.com/terms-of-use/. You may opt out of any disclosure or use of your personally identifiable information for purposes that are incompatible with the purpose(s) for which it was originally collected or for which you subsequently gave authorization by following the instructions at the end of this Privacy Policy, or by following the procedures set forth in an electronic communication from us, if applicable. There are some uses from which you cannot opt-out, such as our use of information about you in connection with providing support that you request for the Website.

Your California Privacy Rights

Under California's "Shine the Light" law, California residents who provide personal information in connection with obtaining products or services for personal, family or household use are entitled to request and obtain from us once per calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2015 will receive information regarding 2014 sharing activities). To obtain this information with respect to Healthy Beverage, please send an email message to info@steaz.com with "Request for California Privacy Information" in the subject line and in the body of your message. We will provide the requested information to you at your email address in response. Please be aware that not all information sharing is covered by the "Shine the Light" requirements, and only information on covered sharing will be included in our response. Additionally, because we may collect your personal information from time to time, California's Online Privacy Protection Act requires us to disclose how we respond to "do not track" requests and other similar mechanisms. Currently, our policy is that we do not recognize "do not track" requests from Internet browsers and similar devices.

European Union Users

Because our Website is accessible globally, the information that we collect may be made available to our affiliates, partners and subsidiaries worldwide. For those users visiting us from the European Union, please note that we may transfer your personally identifiable data outside the European Union for use for any of the purposes described above. By using the Website and providing us with your personal data, you consent to such transfer of your personal data.

Governing Law

You agree that the Website will be deemed solely based in the Commonwealth of Pennsylvania, and the Website will be deemed a passive website that does not give rise to personal jurisdiction over us, either specific or general, in jurisdictions other than the Commonwealth of Pennsylvania. These Terms shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania, United States of America, without reference to conflicts of laws principles. By using or accessing the Website, you agree and hereby submit to the exclusive personal jurisdiction of the state and federal courts located in the Commonwealth of Pennsylvania. You further agree to comply with all applicable laws regarding the transmission of technical data exported from the United States and the country in which you reside (if different from the United States).

Your Consent To This Privacy Policy

By using the Website, you consent to the collection and use of information by us as specified above or as we otherwise see fit unless you inform us otherwise by means of the procedure identified below. If we decide to change this Privacy Policy, we will make an effort to post those changes on this web page so that you will always be able to understand what information we collect, how we use that information and under what circumstances we may disclose that information to others. Your use of the Website following any amendment of this Privacy Policy will signify your assent to and acceptance of its revised terms. We may use comments, information or feedback that you may submit in any manner that we may choose without notice or compensation to you. If you have additional questions or comments of any kind, or if you would like to have any or all of your personal information withheld from third party organizations and companies and/or from third party service providers, please let us know by email or by sending your comments or requests to:
